Terms and Conditions

 

1. General

 

1.1 These terms and conditions shall apply to orders placed on-line through this website and to orders placed by telephone or by post.

 

1.2 None of the provisions of these terms and conditions affect the customer’s statutory rights.

 

2. Colour variations

 

2.1. Colours may vary from the illustrations due to the limitations of the reproduction process for the photographs.

 

2.2. Most of the items for sale are individually made and/or painted and may vary from the illustrations in details and/or colouring. Where there may be significant variations (eg cats) this is noted.

 

2.3. The furniture is made from real wood and may vary in colour and finish.

 

2.4. Where items have been sold and are displayed in the galleries it may be possible to order similar items but these will not be identical to the items that have previously been sold.

 

3. Payment

 

3.1. Payments for on-line orders may be made from a PayPal account or, through the PayPal gateway, by credit or debit card.

 

3.2. Payments by post may be made by a sterling cheque sent to Malcolm’s Miniatures, 14 Oakdene, Woodcote, Oxfordshire RG8 0RQ. Cheques must be made payable to Malcolm's Miniatures.

 

3.3. Payments by phone may be made by credit or debit card (Mastercard, Maestro, Visa, Visa Electron or JCB).

 

4. Delivery

 

4.1. Small items will be despatched by first class post within the UK and by airmail outside the UK.

 

4.2. Small items that are in stock will normally be despatched within two working days from receipt of payment.

 

4.3. For payments made by cheque, receipt of payment will be deemed to be when the cheque has been cleared or, at the discretion of the vendor, when the cheque has been received.

 

4.4. Large or heavy items (eg houses, room boxes, shops, etc that require special packaging for transit) will be despatched by courier.

 

4.5. Large items will normally be despatched within five working days of receipt of payment.

 

5. Cancellation

 

5.1. Customers have the right to cancel orders up to the time when the goods have been despatched (see 4.2 and 4.5 above).

 

6. Returns

 

6.1. Customers may return goods in the original (or equivalent) packaging and condition within 14 days after receipt if not satisfied with the goods.

 

6.2. Returned goods must be sent to Malcolm’s Miniatures, 14 Oakdene, Woodcote, Oxfordshire RG8 0RQ with a note indicating whether a replacement or refund is required.

 

6.3. If the goods are faulty or have been damaged in transit, return postage will be refunded by the vendor otherwise return postage will be paid by the purchaser.

 

7. Commissions

 

7.1. For commissioned work the vendor reserves the right to request a deposit before work commences and for large commissions the right to request staged payments.

 

7.2. The customer has the right to cancel the order for commissioned work and receive a refund of the deposit up to the time when work commences on the commission. If materials specific to the commission have been ordered the commencement of work shall be deemed to be the time when the orders for the materials have been placed.

 

7.3. The customer has the right to cancel the order up to 7 days after work commences or materials have been ordered. Refund of the deposit at this time is at the discretion of the vendor.

 

7.4. The commissioned item(s) shall remain the property of the vendor until the final payment has been received.

 

7.5. In the event of non-payment of the final instalment, refund of any deposit or stage payment shall be solely at the discretion of the vendor.
